Terms of Service

1. Acceptance of Terms

By registering an account, accessing, or using the dalathubai.com website and the DALATHUB AI mobile app (collectively the "Service"), you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Service Description

DALATHUB AI is a SaaS platform for AI-powered content creation, including but not limited to: AI video generation, AI image generation, video face swap, text-to-speech, social-media downloader, and audio processing. The Service operates on a Credit-based payment model.

3. User Accounts

• You must be at least 13 years old (or 18 where local law requires it) to create an account. Minors under 18 need parental/guardian consent.
• You are responsible for safeguarding your password and for all activity that happens through your account.
• Registration info must be accurate and complete. Fake or impersonation accounts are prohibited.
• Each individual may keep one primary account. Using multiple accounts to abuse promotions/refunds will result in full ban.

4. Acceptable Use — Prohibited Content

You may NOT use the Service to create, upload, or distribute:

• Child sexual abuse material (CSAM) — instantly reported to the authorities.
• Non-consensual nudity, pornography, 18+ content of any person.
• Deepfakes intended for fraud, defamation, or impersonation.
• Content inciting violence, terrorism, suicide, or hatred based on race/religion/gender.
• Instructions for making weapons, explosives, or drugs.
• Material that infringes third-party copyright or trademark.
• Malware, virus code, cyber-attack tooling.
• Spam, fraud, unauthorized advertising, MLM schemes.
• Anything that violates Vietnamese law or applicable international law.

Violations lead to permanent account ban, forfeiture of used Credits, and potential legal action.

5. Intellectual Property

• Your uploaded content (images, video, prompts, audio) remains yours. By uploading, you grant DALATHUB AI a non-exclusive, limited license to process the content through AI models and return the result to you.
• AI outputs: you have full rights to use AI-generated results for personal or commercial purposes provided you do not violate Section 4. DALATHUB AI claims no revenue share.
• Platform & software: source code, UI, logo, and the "DALATHUB AI" brand belong to DALATHUB Trading & Service Co., Ltd. No copying, redistribution, or imitation without written permission.
• You are legally responsible for any content you upload, including content automatically processed by AI and returned as output.

6. Payment and Credits

Credit top-ups, payments, and refunds are governed by the Payment Policy and Refund Policy. By topping up, you agree to both policies.

7. Disclaimer

The Service is provided "AS IS" and "AS AVAILABLE." DALATHUB AI does not warrant that:

• AI outputs will always be accurate or match your expectations — quality depends on your prompt, input file, and the underlying third-party model.
• The Service will be uninterrupted or error-free — we may need to perform maintenance or downtime.
• Third-party AI providers (Google VEO, OpenAI, 302.AI, AIVoices, etc.) will always be available — if a provider discontinues their service, the corresponding feature may be paused (paid Credits will be refunded).

8. Limitation of Liability

To the maximum extent permitted by law, DALATHUB AI's liability to you — under any theory (contract, tort, negligence, etc.) — shall not exceed the total amount you paid to the Service in the 12 months preceding the event.

We are not liable for indirect, consequential, lost-profit, or data-loss damages caused by content you uploaded or AI outputs returned to you.

9. Termination

We may suspend or terminate your account (and erase all data) if we detect:

• Violation of these Terms.
• Fraud, abuse, or harm to the system or other users.
• A legitimate request from a competent authority.

You may close your account at any time from the Account page or by contacting us. Remaining Credits will not be refunded in cash but can be used until full deletion.

10. Governing Law & Disputes

These Terms are governed by the laws of Vietnam. Disputes shall first be resolved through good-faith negotiation. Failing that, disputes will be brought before the competent People's Court of Da Lat City, Lam Dong Province, Vietnam.

11. Changes

We may update these Terms. New versions take effect upon publication. Continuing to use the Service after a change indicates acceptance of the updated Terms. If you do not agree, stop using the Service and contact us to close your account.
